CERF and CERA hope that this nation of many cultures can be one nation where all our citizens are protected equally by the Constitution and its Amendments. In contrast, S.578 and H.R. 2242 are expressions of the tribal establishment’s long-range agenda.
Their agenda would:
1. Establish the dominant group in over 560 tribes with “inherent sovereign [independent, supreme] authority” “to establish its own form of government;” and to adopt whatever “constitution or other organic governing documents” it chooses and to establish any “tribal judicial system” it pleases (Section 2).
2. Give these tribal governments a status “similar” but really superior to states (in this case for homeland security purposes) without the human rights safeguards and protections of either state or federal constitutions (Sections 3-12).
3. Subject about 480,000 tribal members, over 440,000 non-members and untold millions passing through or “having sufficient contacts with that land, or with a member of the Indian tribal government” to the “applicable criminal, civil, and regulatory laws” of whatever tribal government, constitution and judicial system is established (Section 13).
And this is supposed to improve homeland security? This is radical enough, but unfortunately, it’s just the leading edge of a much larger balkanization agenda. Already the idea of race-based rights and ethnic nationalism is being debated for Native Hawaiians (S.344/H.R.665). Why do you think both Senators from Hawaii (without a single Indian tribe) have spent their careers on the Senate Committee on Indian Affairs? Racial separatism and eventual independence for the “indigenous” people of Mexican ancestry in California, Arizona, New Mexico, and Texas is stirring and, evidently, is at least partly supported by California Lt. Governor, and potential Governor, Bustamante. Balkanization multiplies, and is capable of destroying any nation. Anyone who doubts that should read The Disuniting of America by Arthur M. Schlesinger, Jr. Where is the media on all of this? This disruptive agenda deserves to be deep-sixed decisively and permanently.
